Terms and Conditions — CES Online

Circular Energy Storage Research and Consulting is a sub-organisation of Creation Inn Ltd, registered at 6 Hillfield Park, London, N10 3QS, United Kingdom. Throughout this website (www.circularenergystorage.com and www.circularenergystorage-online.com) we refer to Circular Energy Storage Research and Consulting as CES, Circular Energy Storage, CES Research and Consulting or Circular Energy Storage Research and Consulting.

 

1. CES Online

CES Online is a website owned and operated by Circular Energy Storage Research and Consulting. These Terms set out the conditions under which you may use our website and services. CES Online provides users who have subscribed — either through an online purchase on this site or through direct contact with representatives of CES — with access to data, forecasts, indices, and research on the global end-of-life market for lithium-ion batteries. Non-subscribers can access a limited amount of information. These Terms apply to both subscribers and non-subscribers.

By accessing or using the website or our service, you confirm that you have read, understood, and agree to be bound by these Terms.

 

2. Subscription plans

CES Online is offered under three subscription types:

2.1 Team Access (annual, multi-user)

Team Access is an annual subscription for use by multiple named users within a single organisation. Access lasts from the day of first log-in by the first user until the 365th day thereafter, unless the subscription is renewed and payment received.

  • Each Team Access subscription includes a defined number of named user seats (default: up to 5 users; larger team sizes available on request).

  • Each seat must be assigned to a specific named individual employed by, or under direct contract to, the subscribing organisation. Login credentials are personal and must not be shared.

  • Seats may be reassigned to a replacement individual (for example, when a team member leaves the organisation) at no additional cost. Seats may not be rotated between users to extend effective access beyond the licensed number of seats.

  • Team Access covers a single legal entity. Use by parent companies, subsidiaries, affiliates, joint ventures, or external consultants is not included unless specifically agreed in writing.

  • Access for additional users beyond the licensed number of seats is available by adding seats to the subscription at the prevailing per-seat rate.

 

2.2 Single-user annual subscription

An annual subscription for one named user, valid for 365 days from first log-in unless renewed.

 

2.3 Flexible subscription (monthly, one user)

A rolling monthly subscription for one named user. The subscription renews automatically every 30 days unless cancelled before the renewal date. On cancellation, access continues until the end of the current 30-day period. Renewals are non-refundable.

 

2.4 Pricing and changes

Prices for all subscription types are listed on the Plans and pricing page, or quoted directly by CES for Team Access agreements above the standard seat count. We reserve the right to change prices at any time and to correct pricing errors that may inadvertently occur. Price changes do not affect subscriptions already paid for within their current term.

 

2.5 Misuse of access

Sharing of login credentials, use of CES Online by unlicensed users, or any other circumvention of the seat structure is a material breach of these Terms. CES reserves the right to suspend or terminate access without refund where such misuse is identified, and to invoice for the additional seats that should have been licensed.

3. Refunds and cancellations

Because CES Online contains continuously updated market information of immediate value, we cannot offer refunds once a user has logged in for the first time. Subscriptions may be cancelled at any time to prevent future renewal, but no refund will be issued for the unused portion of a current subscription period.

 

4. Data, forecasts, and intellectual property

All data, forecasts, indices, research publications (including Research Updates, the CES Battery Value Index, and the Used Battery Value Forecast), methodologies, and analysis published on CES Online or in CES communications are the property of Circular Energy Storage.

 

4.1 Permitted use

Subscribers and non-subscribers may use CES content for internal business purposes within their own organisation.

CES content may be cited or referenced externally (for example in reports, presentations, regulatory submissions, or media) provided that:

  • CES is clearly identified as the source (e.g. "Source: Circular Energy Storage, [Publication Name], [Year]");

  • the citation does not misrepresent the content or its limitations; and

  • the volume of content reproduced is limited to what is reasonable for the purpose (e.g. a single chart, a specific data point, or a short quotation).

 

4.2 Prohibited use

The following uses are not permitted without prior written consent from CES:

  • resale, sub-licensing, or redistribution of CES content in any form;

  • inclusion of CES data in any commercial data product, index, benchmark, or subscription service;

  • bulk extraction, scraping, or systematic downloading of CES content;

  • use of CES content to train, fine-tune, evaluate, or otherwise develop machine learning or artificial intelligence models;

  • use of CES content as input, context, or retrieval source for AI assistants, chatbots, or automated agents made available outside the subscriber's own organisation;

  • use of CES content in any way that competes with CES Online or CES advisory services.

Internal use of AI tools (for example, asking an internal LLM to summarise a Research Update for colleagues) is permitted, provided the content does not leave the subscriber's organisation and is not used to train or fine-tune any model.

 

4.3 The CES Battery Value Index and forecast values

Reference values published as part of the CES Battery Value Index, the Used Battery Value Forecast, or any other CES forecast product are assessments, not transactable prices, indicative quotes, or financial benchmarks. They are produced for informational and analytical purposes only.

CES forecast and index values must not be used as the sole basis for transaction pricing, financial settlement, regulatory submission, financial reporting, or contractual obligations without independent validation by the user. Where CES values are used in regulated or legally binding contexts (for example PRO fee submissions or audited financial statements), the user remains solely responsible for the suitability of the values for that purpose.

5. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Circular Energy Storage be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages — including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses — arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Circular Energy Storage assumes no liability or responsibility for:

  • (i) errors, mistakes, or inaccuracies in published data, forecasts, indices, research, or other content;

  • (ii) the accuracy, suitability, or outcome of any forward-looking statement, forecast, projection, scenario, or index value published by CES, all of which are based on information available at the time of publication and are subject to change without notice;

  • (iii) any commercial, investment, regulatory, or operational decision made in reliance on CES content;

  • (iv) personal injury or property damage of any nature whatsoever resulting from a user's access to or use of the service; and

  • (v) any unauthorised access to or use of our secure servers or any personal information stored therein.

CES content is provided "as is" and "as available", without warranty of any kind, express or implied.

 

6. Data protection

CES processes personal data (such as name, email, and company affiliation of subscribers) in accordance with applicable data protection law, including the UK GDPR and EU GDPR where relevant. Personal data is used only to provide and administer the service, to communicate with subscribers about CES products and research, and to comply with legal obligations. CES does not sell personal data to third parties.

Subscribers may request access to, correction of, or deletion of their personal data by contacting info@circularenergystorage.com.

 

7. Communication and customer service

Subscribers and non-subscribers agree to receive occasional promotional messages and materials from CES by email. You may unsubscribe at any time. CES aims to respond to subscriber enquiries within three working days. The customer service email is info@circularenergystorage.com.

 

8. Changes to these Terms

We reserve the right to modify these Terms from time to time at our sole discretion. You should review this page periodically. Where we make material changes, we will notify subscribers. Continued use of the website or service after such changes constitutes acceptance of the new Terms. If you do not agree to any current or future version of these Terms, do not access or continue to use the website or service.

 

9. Governing law and jurisdiction

These Terms, the rights and remedies provided under them, and any claims or disputes related to them or to the services, are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-laws principles. Any claim or dispute shall be brought exclusively before the courts of London, England, and you consent to the exclusive jurisdiction of those courts.
